TERMS AND CONDITIONS OF THE PARTICIPATION

in the Art Master Classes

§1.

GENERAL PROVISIONS

  1. The Organiser of the Art Master Classes (hereinafter referred to as the „Classes”) is the Polish Foundation for Culture and Development (hereinafter referred to as the „Organiser”).
  2. The Clases shall be held from 19 to 28 July 2024 in Tarnów.
  3. As part of the Art Master Classes, there shall be held:
  1. Music Classes for students of upper secondary music schools, students of music colleges and graduates up to the age of 30 (hereinafter referred to as „Participant”) and other persons interested in taking part in a passive manner (hereinafter referred to as „Passive Participant”). Students of music schools of the first degree representing a very high level of instrument performance are allowed to participate / eligibility for the Classes is decided by the Commission on the basis of the materials submitted regarding the Participant’s achievements and the recording provided.(Point 16)
  1. Visual Arts Classes for art secondary school students, art university students and adults up to 30 years of age wishing to broaden their artistic skills.

Additional activities

for all Participants in Music and Visual Arts Classes

– basics of marketing and PR,

– fundraising for artists and self-management. 

– Yoga for artists The art of concentration – the art of relaxation /each participant should have their own yoga mat/

– psychology of success; lecture and exercises

– grants,

– law of copyright,

§2. 

CONDITIONS OF PARTICIPATION

  1. FEES FOR PARTICIPANTS IN MUSIC CLASSES

Solo instrumentalism:

active participant   – PLN 1600 

passive participant – PLN 800

Chamber music:

Active participant – PLN 1200

Costs of accommodation is not included.

Advance payment: – PLN 500

Advance is non-returnable

Active participant in music classes

as part of the fee of PLN 1600 will be guaranteed:

Solo instrumentalism:

– 5 individual lessons of 45 minutes each with a professor of your choice,

– the opportunity to work with a pianist, 

– a chamber music class (for those who wish),

– free admission to masterclasses performed by professors conducting        

   instrumental masterclasses as part of the Classes,

– free entrance to all artistic events organised as part of the Classes,

– free admission to selected cultural institutions in Tarnów,

– performance during a minimum of one concert of the participants, max. two recitals,

– practice rooms,

– group panels on the basics of marketing and PR and self-management. 

– fundraising for artists,

– yoga for artists The art of concentration – the art of relaxation /each participant should have           their own yoga mat/,

– copyright classes for artists,

– practical project writing classes.

Active participants in solo instrumentalist classes also have the opportunity to take part in 

chamber music classes.

Applications should indicate your wish to take part in the class as well as whether you have your own ensemble or wish to be assigned to a class ensemble by the lecturers.

     Chamber music:

 – 5 chamber music/ensemble classes,

– free admission to masterclasses performed by professors conducting instrumental masterclasses on the Classes,

– free admission to all artistic events organised as part of the Classes,

– free admission to selected cultural institutions in Tarnów,

– performance during a minimum of one concert of the participants, max. two recitals,

– practice rooms,

– group panels on the basics of marketing and PR and self-management.

– copyright classes for artists,

– practical project writing classes,

Assignments to the ensembles as well as repertoire and music material will be sent to participants at the latest two weeks before the beginning of the classes, so that each participant has time to prepare their own part.

The class takes place with a minimum of 8 students per group/instrumental class

Passive participant in music classes / observer as part of the PLN 800 fee is guaranteed:

– free admission to masterclasses performed by professors conducting  instrumental master classes as part of the Classes,

– observation of all solo and chamber instrumental lessons,

– free admission to all artistic events organised as part of the Classes,

– free admission to selected cultural institutions in Tarnów,

– group panels on the basics of marketing and PR and self-management.

FEES FOR PARTICIPANTS IN VISUAL ARTS CLASSES

Cost of participation: PLN 800, 

Costs of accommodation is not included.

Advance payment:      PLN 500

Advance is non-returnable

All materials needed for the classes /artbox/ provided at a cost of PLN 210.

Participant of Visual Arts Classes

as part of the PLN 800 fee is guaranteed:

– arts and crafts classes from Monday to Friday 4 hours a day,

– easel, paper pads, water dishes, models

– free admission to masterclasses performed by professors conducting  instrumental masterclasses as part of the Classes,

– free entrance to all artistic events organised as part of the Classes,

– free entrance to selected cultural institutions in Tarnów,

– group panels on the basics of marketing and PR and self-management.

– copyright classes for artists,

– practical project writing classes,

The Classes take place with a minimum of 8 participants. The organiser reserves the right to cancel the Classes if the number of participants is too low.

2. The fees set out in point 1 do not include the costs of accommodation and meals, which are borne by the Participants themselves. 

3. Each participant of the Visual Arts Classes must bring his/her own materials, a list of which will be given with the confirmation of acceptance of the application, or purchase a dedicated artbox which contains all the necessary materials for the duration of the Classes.

4. Each Active Participant of the Music Classes should bring their music notes, accompaniment notes, lectern and black concert outfit. 

5. Active Participant and Passive Participant under 18 years of age may participate in the Classes only when accompanied by an adult guardian, subject to point 7. The guardian’s details should be provided on the application form under „Additional information”. 

6. The guardian shall pay the fee of PLN 200 and shall be guaranteed free access to concerts and artistic events accompanying the Classes. 

It is also possible for a Guardian to attend all lectures upon payment of PLN 800, thus acquiring the status and rights of a Passive Participant.

7. Active Participants and Passive Participants under the age of 18 may participate in the Classes without a guardian only on condition that they have a Declaration to this effect signed by their parents/legal guardians.

A scan of the Declaration should be attached to the Application Form. The original must be submitted no later than the starting date of the Classes.

8. Teachers from home schools delegating Active Participants receive a 50% discount on participation as an observer / Passive Participant in all Self-Management classes, instrumental lessons and concerts.

9. Applications for the Classes are electronic only, via the application form,  1.04.2024- 30.05.2024 r.

As part of your application you should submit:

  1. A completed Application Form,

b    Artist CV with a list of achievements,

  1. Payment confirmation of the deposit of PLN 500,
  2. Parents’/Guardians’ declaration – scan (the original must be submitted on the starting day of the Classes at the latest)
  3. * Optional for participants of Music Classes

Recording of one complete piece of music or a part of a piece of music up to a maximum of 10 minutes, reflecting the level of advancement of playing the instrument (for participants of Music Classes), Sharing a YT link.

10.  The organiser will confirm receipt of the application by email no later than 30.06.2024.

11. A participant applying as a pre-formed chamber ensemble shall enter the details of all members of the ensemble under „Additional information”.

12. Application to the Classes does not constitute acceptance to the Classes. 

13. The Participants and Passive Participants will be informed about their qualification for the Classes by the Organiser via e-mail no later than 30.06.2024.

14. Depending on the number of applications received, the Organiser may decide to extend the recruitment for the Classes, which will result in an extension of the deadline for the announcement of the results of the recruitment mentioned in point. 8.

15. The Organiser reserves the right to cancel the Classes if the number of participants is too low.

16. A formal requirement for participation in the Classes is that the Participant correctly fills in all the necessary fields in the application form, confirms payment of the deposit of PLN 500 and optionally provides the recording described in point 8e

Participants will be selected on the basis of the information contained in the application form and the recordings made available / applies to Participants of active Music Classes.

  1. Only applications meeting the formal conditions will be admitted to the commission’s consideration. 
  2. Decisions of the commission cannot be appealed against.
  3. The commission deciding on eligibility for the Classes shall be composed of the professors of the Classes and the artistic director.

The total cost of participation in the Classes shall be paid to the bank account specified in point 21 upon receipt of notification of acceptance into the Classes not later than 10.07.2024. The date of payment for the Classes shall be the date on which the Organiser’s bank account is debited.

Payment title: Art Master Classes VISUAL ARTS / MUSIC (select appropriate profile) , name of participant , and possible booking of artbox / visual arts class participants.

  22. The advance payment and fees may be reimbursed due to important fortuitous reasons (documented) or as a result of cancellation of participation in the Classes, notified in writing at least 10 days before the commencement of the Classes. Arrival at the Classes late will not result in a refund of unused fees.

  23. The Class Participant should be self-insured against medical expenses and accidents. He/she should also carry any necessary medication that he/she takes regularly.

§3. 

ORGANISATIONAL PROVISIONS REGARDING CLASSES

  1. As part of participation in the Classes, each Participant is guaranteed 5 lessons with a chosen teacher (45 minutes each) according to a schedule set by the Organiser. In addition, each Participant may rehearse with a pianist. The rehearsal schedule is agreed directly with the pianist.
  2. The participant shall be obliged to be punctual, follow the schedule of the Classes and take care of the Organiser’s property and property made available to the Organiser for the duration of the Classes by other entities.
  3. In the event that a class is shortened or does not take place for reasons attributable to the teacher, the Participant will be offered another class date for all or the relevant part of the missed class (more than 10 minutes shortened).
  4. In the event that the class is shortened or does not take place for reasons not attributable to the Organiser, the Participant shall not be entitled to any claims.
  5. The classes and materials received during the classes are of an informative and advisory nature on the basis of the original programme prepared by the teacher. The Organiser is not responsible for the content and course of the class, nor for the content of the materials.
  6. Participants’ participation in Concerts within the Classes is decided by the teacher in charge of the respective instrumental/ chamber music class.
  7. The Participant in a recital may perform solo or with a pianist. The frequency and timing of rehearsals for the concert with the pianist are agreed individually by the Participant and the Pianist.
  8. The Organiser provides the concert’s technical service and audience support.
  9. The concerts and exhibitions, as well as the Participants performing during them, will be actively promoted in all the Organiser’s and Partners’ information channels.
  10. The Organiser takes no responsibility for participants’ instruments or their property.

§5. 

PERFORMANCE RECORDING

  1. The Organiser has the right to record all classes, concerts, exhibitions within the Classes.
  2. By registering for the Classes using the application form, the participant automatically agrees to the recording of classes, concerts and exhibitions with his/her participation, including the use of his/her image and personal data.
  3. The consent referred to in point 2 shall also constitute consent for the gratuitous transfer to the Organiser of all economic copyright to the works determined by the Participant during the Classes and all related rights to the artistic performances determined by the Participant during the Classes. The Organiser receives the works and artistic performances as soon as they are established by the Participant.
  4. The organiser has the right to use the established works and artistic performances specified in point 3 in an unlimited time and territory manner in the following fields of exploitation:

– recording / registration of material on any audiovisual medium, in particular: video media, photosensitive tape, magnetic tape and computer disk,

– multiplication by any technique, including video and audio cassettes, audiovisual discs, by celluloid, photosensitive and digital techniques, by computer recording technique,

– public performance and display (television, radio, multimedia, Internet broadcasting, etc.),

– broadcasting in whole or in fragments by wire or wireless vision and sound, by any technique – regardless of the system, standard and format, including broadcasting by a terrestrial station and cable broadcasting,

– introduction into computer memory and multimedia networks,

– making a piece of work available to the public in such a way that everybody can have access to it at a place and time individually chosen by them, 

– any use of the material in interactive services made available to viewers via the Internet and other data transmission techniques, including telecommunications, IT and wireless networks

§6. 

FINAL PROVISIONS

  1. Any issues not covered by the Terms and Conditions shall be decided by the Organiser.
  2. Application to participate in the Classes is considered as acceptance of these Terms and Conditions.
  3. In the event of non-compliance with these Terms and Conditions, the Organiser reserves the right to remove the Participant and Passive Participant from the Classes.
  4. The organiser reserves the right to make changes to these Terms and Conditions in writing.
  5. The Terms and Conditions shall become effective from the date the Organiser commences recruitment.
  6. In the event of so-called force majeure, the Organiser reserves the right to cancel the Classes. Force majeure shall be events beyond the will of the contractual parties, significantly affecting the possibility of organising the Classes, of an exceptional and momentous nature, such as in particular:
  • the entry into force of regulations or the issuing of orders by the competent services which imply an obligation not to hold festivities and cultural events,
  • acts of nature, such as, in particular, flood, fire, earthquake
  • acts of war or other operations of the armed forces and terrorist acts.

Information clause

1) In accordance with Article 13(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data

3) Personal data obtained as a result of concluding a contract with you will be processed for the following purposes:

  • related to the performance of the contract signed with you; related to the investigation of possible claims, damages; responding to your letters, requests and complaints; responding to pending proceedings.

4) The legal basis for processing your data is:

  • the necessity to perform the contract or to take action at your request prior to the conclusion of the contract (Art. 6(1)(b) GDPR),
  • the necessity to comply with a legal obligation incumbent on the controller (Article 6(1)(c) GDPR),
  • necessity for the purposes of the legitimate interests pursued by the controller (Article 6(1)(f) GDPR).

5) The provision of personal data is voluntary, but necessary for the conclusion and execution of the contract.

6) The personal data collected from you may be transferred:

  • o entities processing them on our behalf and to public authorities or entities entitled to obtain the data on the basis of applicable laws, e.g. courts, law enforcement agencies or state institutions, when they make a request, based on the relevant legal basis.

7)Your data will not be transferred to third countries.

8) The duration of the processing of your personal data depends on the purpose for which the data

are processed. The period for which your personal data will be stored is calculated

based on the following criteria:

  • the duration of the contract, legal provisions that may oblige us to process the data for a certain period, the period that is necessary to defend our interests.

9) Furthermore, we inform you that you have the right to:

  • access to your personal data; request the rectification of your personal data which that are inaccurate and to complete incomplete personal data; to request the erasure of your personal data, in particular where you have withdrawn your consent to the processing when there is no other legal basis for the processing; to request the restriction of the processing of your personal data; to object to the processing of your data, on the grounds of your particular situation, in cases where we are processing your data on the basis of our legitimate interest or for the purposes of direct marketing; to portability of your personal data; to lodge a complaint with the supervisory authority dealing with the protection of personal data, i.e. the President of the Office for the Protection of Personal Data

10) To the extent that your data is processed on the basis of consent – you have the right to withdraw your consent to data processing at any time. The withdrawal of your consent shall not affect the legality of the processing performed on the basis of your consent prior to its withdrawal of your consent. You may withdraw your consent by sending a statement of withdrawal of consent

to our postal address or e-mail address.
